Agreement
Use of the website and/or other services offered by the TUI AG and/or its subsidiaries are subject to the following conditions of use.

Information on the website
The information made available by the TUI AG on its websites are subject to constant supervision and regular updating. It is nevertheless possible, despite thorough checking, that information has meanwhile changed. For this reason, the TUI AG gives no guarantee of, nor accepts liability for the accuracy, completeness or topicality of the information given on these sites.

Links to other websites
The website contains hyperlinks to websites of other suppliers. aqi has no control over their form and content and therefore accepts no liability for the correctness, topicality, completeness and quality of the information made available there. The user must address any reservations he/she has in connection with a certain website, directly to the respective provider.

Changes to the website
The TUI AG reserves the right to undertake changes to the website or its contents at any time, especially in relation to the choice of suppliers, features, information and data bases, or their contents.

Use of the website
The website is intended solely for the user’s personal use. Travel services that are made available through the website are not to be sold on to, obtained for, or otherwise handed over to third parties for a fee. The website is to be used lawfully and as stipulated in the contract, with special regard to these conditions of use. Contractually stipulated refers solely in this case to the reservation and booking of travel services, as well as every other lawful use of the functions installed on the website.

Use of website:
a) The user is personally and financially responsible for all web-based transactions that occur under his/her name or account details, as long as the user’s chosen password has been entered.
b) The user must be at least 18 years old and fully competent.
c) The user assures that all personal information provided, regarding himself/herself or his/her fellow travellers, is accurate.
d) Use of the website for speculative purposes, false or fraudulent bookings, including block bookings, is not permitted.
e) The transmission of threats, coercion, defamation, as well as pornographic, racist, xenophobic, or in any other sense, unlawful material, is expressly forbidden.
f) The user is not permitted to alter, transmit, sell, publish or in any way reproduce the website or its contents. The making of a single copy of the site for personal and non profit-making use is permitted.
g) Files containing software or other material, protected under commercial or copyright law, or which are protected under privacy law, may not be publicly circulated. An exception being when the user has entitlement, or has obtained the requisite authorization.
h) Files containing viruses, corrupted files, or software which could damage the computers of third parties may not be uploaded.
i) Assignments of the author, legal references, copyright indications or markings, contained in a loaded file (software or other material), may not be deleted or falsified.
j) Products or services are neither to be obtained, nor offered for sale. Surveys, competitions or chain letters may not be circulated.
k) Access to the aQi hotel website must be through the homepage only. Written permission from the TUI AG is required before accessing other pages of the website. The same is also required before links can be shown inside frames.

The above rules also apply to bulletin boards, chat rooms and other communications forums on the website. All forums will provide public and not private communication. The TUI AG will neither check, nor approve any third party contributions before their insertion in these forums. The TUI AG reserves the right to remove from the forums, without prior warning, any content communicated between, or sent by users. The TUI AG also reserves the right, at its own discretion and without prior warning, to refuse a user access to the website or its elements. The user commits himself/herself to not make the TUI AG, its related or partner companies nor their members of staff liable for any claims by third parties (including adequate legal costs), that are based on usage of this website and its contents that is improper, illegal or not contractually agreed upon.

Denying access
The TUI AG has the right to deny access to the website and/or online services at any time.

Software
The TUI AG and its related or partner companies are owners of all rights to the website software, which aQi hotel has provided for download. Any illicit usage, reproduction or propagation of such software is expressly forbidden. Use of the software can be subject to particular licensing agreements and their conditions. When such an agreement is not in force, the owner of the software grants the user forthwith a personal, non transferable user right, which extends only to private use of the software, for the purpose of access, representation and the contractually stipulated use of the website in agreement with these conditions of use. Any reproduction of the software on any other server or data carrier with the intention of further reproduction is explicitly forbidden. Any software, which has been provided on the website for download, carries copyright protected material belonging to aQi hotel and/or its suppliers.

Your use of the software is subject to the conditions of the licensing agreement for end-users, which the software is provided with or part of (‘Licensing contract’). The user is not allowed to install, copy or use any software which is accompanied by or includes a licensing contract, if he/she has not first declared himself/herself to agree to the conditions of the licensing contract. For software which is not accompanied by a licensing contract, TUI AG will grant the user a personal, non transferable licence permitting use of the software, with the express purpose of viewing or otherwise using the website, in accordance with the given rules and conditions. When the user installs, copies, or otherwise uses the software, he/she declares himself/herself to agree to the rules and regulations. The user must consider that the complete software, including but not restricted to the complete HTML codes, ActiveX controls and other scripts contained in the site, are the property of TUI AG and/or its suppliers and therefore protected under copyright law and by international contract agreements.

The user is only permitted to make copies of the software for archival or data protection purposes. Any other reproduction or propagation  of the software is legally and explicitly forbidden and can lead to prosecution and high fines. The user is not permitted to employ reverse engineering to retrace, decompile or disassemble the software. Further still, the copying or reproduction of the software onto another server or other location intended for the making of further reproductions, or for sales purposes is explicitly forbidden. A guarantee of the software is only made in accordance with the conditions of the licensing contract, if at all.

All rights reserved. The content and structure of the aQi hotel websites are subject to copyright law and other regulations for the protection of intellectual property. Any propagation or alteration of the contents of these pages is not permitted, in addition to which they are not to be copied, nor made available to third parties. Copyright law also covers the images, that third parties have made available to the TUI AG. The Name aQi hotel is a trademarks of the TUI AG. The user is granted no rights, nor licenses for the use of these trademarks.

Data protection
TUI AG places great importance on protecting your privacy. We also pay a great deal of attention to the aspect of privacy in the operation of our internet activities. Personal data are not gathered on this aQi hotel website, which is intended purely to provide customers with information. As no personal data are acquired, no data can be used and processed.

Our online offering contains links to other websites. Our above declaration on data protection does not apply to other providers. We have no influence as to whether their operators comply with the data protection regulations and therefore we can accept no responsibility as to whether the data given there is correct, up to date, complete and of the proper quality.
