1. Contractual relations
TUI AG offers on this website an online booking function for guests wanting to stay at the hotel. The customer can check the availability of accommodation and make a booking straight away. Our General Terms and Conditions apply to every use of this service.
Booking accommodation via this website creates an accommodation contract between the hotel in question and the customer.
TUI AG is involved exclusively as an intermediary agent of the accommodation services. In addition to these General Terms and Conditions of TUI AG acting as an agent the Terms and Conditions of the respective hotel apply to each booking made.
2. Costs of arranging the booking
The presentation of the hotel services via this website and the use of the website services is free of charge for the customer.
3. No extra services
The booking of accommodation services includes neither a transfer service nor care and support of the customer by a tour rep in the destination nor does it include the journey to the destination. Moreover the extra services usually included when paying with a TUI Card Classic or a TUI Card Gold are not included when these hotels are booked.
4. Guaranteed/non-guaranteed booking
The details pertaining to booking cancellations (guaranteed/non-guaranteed booking) are given in the terms and conditions of each respective hotel.
5. Booking confirmation
The room reservation takes effect already with the booking – a separate confirmation is not given. The customer can print out the reservation created during the booking procedure, at the same time this will be sent to him as an email. Owing to the technical aspects, however, TUI AG cannot guarantee that the mail will be properly delivered. This does not affect the efficacy of the booking.
6. Misuse of the online booking tool
TUI AG endeavours to prevent any misuse of the free booking system and to protect the hotels/provider against any unnecessary incorrect bookings. We consequently reserve the right to refuse or cancel individual bookings if it justifiably believed that the booking involves misuse. Grounds to suspect that misuse is involved are when for example in the past the given credit card number could not be charged or when there is a reason to suspect that bookings have been made not for the customer but for the purpose of speculation.
7. Payment
Normally the room price confirmed by the hotel booking system must be paid upon arrival directly to the hotel/provider. In certain cases the customer’s credit card may be debited with a deposit; more details are given in the respective hotel description.
8. Amendments and cancellations
Amendments and cancellations should always be entered via the booking system on the website so they can be properly dealt with.
9. Hotel categories and information
The usual international hotel classification based on stars gives a non-binding indication of the hotel standard. The hotel classification given is based on the hotel’s/provider’s own estimate. Additional hotel information and descriptions given in the booking system are based on details that the hotel has provided. TUI AG does not take any responsibility for the correctness and relevance of this information, unless TUI AG is guilty of gross negligence or intent with regard to the correctness of the information provided.
The information of the accommodation services offered on the website are to a certain extent taken directly from international computer booking systems. In the corresponding descriptions there may be details given in English that accordingly affect the scope of the service offered. The customer accepts herewith that in relation to the respective hotel/provider such details given in English are part of and valid in the contractual agreement.
10. Pricing
The lowest prices available in the system are displayed according to the specified arrival and departure dates for the listed hotels. The binding offer for the selected hotel in the booking includes the applicable room price in euro or in the national currency equivalent. The rates for the rooms are binding and guaranteed for each reservation. Payment is made at the hotel in the applicable local currency. The definitive price is the price shown in the respective local currency.
All prices are per room and per night, and may, depending on what the hotel offers on a case basis, include or not include board. Statutory VAT and service charge are generally included, but in some cases even additional taxes or fees may charged on top of the room price. Such surcharges are made in response to country-specific regulations. As on-going changes can not be ruled out all the data provided to indicate the amount of the tax are not binding and serve as orientation. 11. Assertion of claims, obligations of the customer
All claims and obligations arising from the accommodation contract exist directly and exclusively between the customer and the chosen hotel/provider.
TUI AG must be notified without delay of any inadequacies in the service provided by them in arranging accommodation so the company has the opportunity to provide a remedy. If such notification is culpably not given then any claims made by the customer within the contract for arranging accommodation become void insofar as a reasonable remedy could have been arranged by TUI AG.
It is the responsibility of the customer to inform himself before starting out on the journey about the valid and pertinent regulations for the destination concerning passports, visas, customs, currency, pets and health.
12. Liability of TUI AG
TUI AG accepts no liability for the success of its organising arrangements or the performance of the accommodation service itself, but only liability that its service of organising arrangements is carried out with due care and diligence. No guarantee is given whatsoever for the correctness, completeness and reliability of third-party content in the booking system, in particular as regards the details of individual hotels, unless TUI AG had previously definite knowledge or was grossly negligent in its lack of knowledge of the incorrectness of certain details. Updating the content is the sole responsibility of the hotel/provider which can be booked via the hotel booking system. Moreover, when a contract is concluded also the terms and conditions as well as any other rules of the respective hotel/provider take effect.
TUI AG shall do its best to ensure that the information and other data available on the website at the time of publication are up-to-date, complete and correct.
TUI AG can, however, not accept any responsibility for the correctness, completeness and reliability of this information and data because maintaining and updating this if the responsibility of the respective hotel/provider.
13. Force majeure
TUI AG shall not be liable under this contract for the consequences of force majeure. This includes orders of authorities, wars, domestic unrest, hijacking of aircraft, terrorist attacks, fire, flood, electrical power failures, accidents, natural disasters, strikes, lockouts or other forms of industrial action, by which the services of TUI AG or its contract partners may be affected.
14. Changes to the Terms and Conditions
TUI AG reserves the right to change or revise the Terms and Conditions for the use of this website at any time with effect for the future without there being any obligation to notify the customer. The respective latest version of the Terms and Conditions will be made available on the website from the time of their becoming valid. By continuing to use the website for new bookings after a change in the Terms and Conditions, the customer declares he agrees to the changes.
15. Safeguarding clause
Should one of the above conditions be or become void, the validity of the remaining conditions shall in no way be affected. In such case the ineffective condition shall be replaced by a condition that comes as close as possible to the economic purpose of the condition to be replaced.
